Understanding Litigation and Dispute Resolution

In a perfect world, we would all be able to solve our differences on our own. However, that is just not always possible. When a disagreement escalates and cannot be resolved privately, legal action may become necessary. Litigation is the formal process of resolving disputes through the court system. It involves presenting evidence and arguments before a judge or jury, who then issue a legally binding decision.

Because litigation can be complex, time-consuming, and often stressful, it’s important for clients to understand both the process and the alternative pathways available.


Our Approach to Resolving Disputes

Every dispute is unique. We work with clients to identify the most effective strategy—whether that means taking a firm stand in court or pursuing a faster, more cost-effective alternative. We want to empower our clients to take the path that is best for them, therefore when possible we will outline multiple options for the client to consider. The client makes the ultimate decision as to the approach we take at each step of the process. 


Mediation

Most litigation cases in Colorado are required to participate in at least one mediation session prior to having a contested hearing or a trial. Mediation is a collaborative, solution-focused approach. A mediator is a neutral third party who facilitates negotiations. If the parties are able to come to a a complete agreement during mediation, then further court hearings will not be necessary. Mediation is often faster and more cost-effective then litigation and allows the parties to reach an agreement that each side can live with. It takes the guess work out of how a judge or jury may rule and allows the parties to have some control over the outcome. We guide our clients through mediation to help achieve practical, mutually acceptable solutions.


Negotiation

Often the first step in resolving a conflict is negotiation. Many disputes can be resolved without any formal proceedings. The negotiation process is usually more Flexible and informal, it allows parties to maintain control over the outcome before they incur substantial legal fees. We strive to negotiate assertively and strategically to secure favorable results while avoiding unnecessary escalation.


Collaborative Law

Litigation can be emotionally draining, financially burdensome, and takes a tremendous amount of time away from the things you would rather focus on. For clients seeking a cooperative approach to avoid the negative side effects of litigation, collaborative law provides a structured alternative. In a collaborative approach, both parties and their lawyers commit to resolving the dispute without going to court and encourage open communication and information sharing. This type of approach is commonly used in family and relationship matters, including divorce, child custody cases, business matters and probate matters.  If the process breaks down, the lawyers withdraw and cannot represent the clients in litigation, encouraging all participants to remain solution-focused.
